Drinking Age

Kaitlyn Turner Fall 2010 CA 110 Mr. Foutz Introduction Attention-Getter: How many of you are 18? For those of you who are, 18 years old you are considered adults in nearly all aspects of the law, including voting rights and the ability to join the military, yet the United States still treats you as minors when it comes to drinking. Establishment of Credibility: According to Substance Abuse and Mental Health Services 7,000 teenagers under the age of 16 have already had their first sip of alcohol. Teen alcohol) According to the Century Council 10 million teens from the ages 12-20 admit to consuming alcohol in the past 30 days. 2% of 12 year olds drink, 22% of 16 years olds drink, and 56% of 20 year olds drink, and these percentages are steadily increasing. (Underage drinking statistics) Thesis/ Purpose: During my speech today, I will talk about how alcohol is ever-present in today’s American society. I will also talk about how alcohol is present all around people under 21 who ar e not allowed to consume it, but in reality most people under 21 drink alcohol and abuse alcohol.Throughout this speech I will try to persuade you to believe that the United States should lower their drinking age to 18, and begin educating teens on consuming alcohol responsibly. Preview of Main Points: First, I will discuss the current legal drinking age in the United States and other countries. Then, I will discuss the effects that the current legal drinking age has on America. Finally, I will talk about the potential benefits of a lower drinking age. ,, Body Main Idea 1: (Transition) Now, I am going to tell you about the current legal drinking age in the United States and other countries.A. United States 1. According to Alcohol Problems and Solutions legal drinking age in the United States is 21. i. Alcohol Problems and Solutions states, â€Å"The minimum drinking age of 21 in the U. S. appears to be not only ineffective but actually counter-productive. Although it was passed wit h the best of intentions, it has had some of the worst of outcomes. † 2. Legal drinking ages in the United States are under control of the states, which means the states get to decide how old they want their residents to be before being able to consume alcohol. . National Minimum Drinking Age Act of 1984 ii. According to the Alcohol Policy Information System the National Minimum Drinking Age Act of 1984 required that states prohibit persons under the age of 21 from purchasing or publicly possessing alcohol beverages as a condition of receiving State highway funds. B. In Other Countries a. According to Alcohol Problems and Solutions countries legal drinking ages vary from zero-21. i. Some countries with no drinking age Jamaica, Viet Nam, and Morocco. ii.Some countries with a 16 year old legal drinking age are Germany, Greece, Norway, Poland, and Spain. iii. Some countries with an 18 year old legal drinking age are Belize, Brazil, Canada, China, France, Ireland, Mexico, Russia, Turkey, and the United Kingdom. (Transition): Now that I have told you about the current legal drinking age in the United States and other countries, I will discuss the effects of the current drinking age. Main Idea 2: The United States legal drinking age of 21, has many negative effects on those who are under age. A.Alcohol is considered a, â€Å"Forbidden Fruit†. Alcohol is considered a forbidden fruit because prohibition increases the harm that it is supposed to reduce. a. Because the United States as such a high drinking age, teenagers are driven â€Å"underground† to drink alcohol. i. According to Parade. com Since teenagers are not allowed to drink openly in public, teens take their drinking to dorm rooms, isolated areas, or at unsupervised house parties. At these gatherings teens usually binge drink, because they are scared their party may be stopped. (Flynn) ii.Also according to Parade. com when teens come about a problem, such as someone drinking too much alco hol at these parties, or assaults, they are less likely to call for help because they are scared of getting in trouble. (Flynn) B. High Rates of Alcohol Abuse and Addiction b. According to the Centers for Disease Control and Prevention binge drinking plays a huge part in Alcohol Abuse. Binge drinking is excessive drinking that brings a person’s blood alcohol concentration to . 08 percent or above. iii. Men – 5 drinks in two hours. iv. Women – 4 drinks in two hours. v.About 90% of the alcohol consumed by youth under the age of 21 in the United States is in the form of binge drinks. Main Idea 3 (Transition): Now that I have told you some of the negative effects of underage drinking, I will tell you about the potential benefits of a lower drinking age. A. Potential Benefits of a Lower Drinking Age a. Young people will learn to drink alcohol more responsibly. i. According to the group Choose Responsibility, if the drinking age is lowered to 18, everyone will be requ ired to take an alcohol education class before they turn 18 to inform them on the dangers of alcohol. . Would lead to less alcohol abuse and addiction ii. Since alcohol would no longer be considered a forbidden fruit, teens could drink in more open environments such as social events and bars where their consumption could be monitored. iii. Some teens may also feel as if they have a more freedom; therefore, they would make more responsible decisions when it comes to consuming alcohol. Isolated figures denied Essay

‘Isolated figures denied the fulfilment they crave by forces that appears to conspire against them’. To what extent is this true of the characters’ lives from your understanding of The Melancholy Hussar of the German Legion? This short story is based on two love triangles, at the apex of both being Phyllis, a secluded young woman who lives alone with her father, a failed doctor in an isolated farmhouse outside Weymouth. It is described as an â€Å"obscure island nook† which encapsulates the fact that there was no fresh work for the failed doctor, Phyllis’ father. One day Richard Gould, a failed businessman, turns up at her door and after a short courtship asks for her hand in marriage. The father immediately accepts this offer as he gets the impression that Gould is of higher social status than him and as the sole benefactor he would profit from their marriage. However, his intentions were well made and although convenient, Gould’s act had forced her father into a mistaken calculation. In his pursuit of illusions, he misses several points, such as the fact he had made her father’s acquaintance before he made hers, giving the impression that he was looking in desperation for a bride. Despite of first impressions, Gould is, in fact, â€Å"poor as a crow† but he gives an impression of having class status. The marriage arrangements were not based on love but were simply a convenience, which results in it being for material security rather than a romantic affair. Gould is then forced to leave to for Bath, an excuse about his father covering up his â€Å"pecuniary condition† leaving Phyllis bemused. The date of his return passed and winter arrived. This change of season is a metaphor, which represents the colour of Phyllis’ mood, described now as â€Å"lonely in the extreme† as she had no knowledge of why her husband to be had delayed his return. The change back to spring represents a change in Phyllis’ fortunes. Although Gould had kept in contact with her through â€Å"regular yet formal† letters, there was still an uncertainty in her condition. Phyllis’ loyalty however did not waver, which is meant to represent the passivity of women at that time in a male-dominated society. At this change, however, a new influence invades her life, which â€Å"charged all youthful thought with emotional interest†. This is the presence of the York Hussars, a military regiment taken from Germany to serve in Britain. They were renowned for their â€Å"foreign air and mustachios which drew crowds of spectators wherever they travelled† which shows Hardy’s evident eye for detail that appears time again throughout the story. Phyllis was sitting on top of a wall at the base of her garden, apparently a favourite spot for her from childhood, when she sees an alien figure walk up the path. One of the soldiers from the Hussars camped nearby was walking up the path, with the manner of â€Å"someone who wishes to escape company†. He is in contrast to the splendid men who usually are the visual front to the Hussars and it seems as though this soldier wished to escape the rigours of military life. The soldier notices Phyllis on the wall, who was dressed in â€Å"white raiment† typically the colour of innocence and inexperience. She is captivated by him and falls in love at first sight. After a few days of this they start talking. She finds out his name is Matthaus Tina and how he was forcibly removed from his home to join the army and had quickly reached the rank of corporal. He was well educated and had soon proved himself in the strongly class-based society of the army. These â€Å"interviews† occurred on a daily basis; soon the conversation spread to his life at home and his longing for his mother. Hardy introduces a scholarly influence by comparing her pity of him to that of Desdemona, a character from Othello, a tragedy by Shakespeare. This is an apt comparison, as the piece itself will eventually turn into a tragedy full of mistaken judgements, well-intentioned actions and undeserved misfortune. The wall is a metaphor for the boundary between them; it is described as being in disrepair, which indicates the unstable base for their romance and the lack of unity. All through the story this wall remains between them until finally when Phyllis attempts to break free. She learns that although the regiment appears happy in fact it was â€Å"pervaded by a dreadful melancholy† powered by a longing for the return for their home showing a background of natural prejudice. This need was driven for a hatred of their English officers and English attitude in general. Matthaus is said to suffer one of the worst from this â€Å"home-woe† and Phyllis pities him but still declined any form of physical contact or even permit him to cross the boundary line of the wall. Coincidentally news reached Phyllis of Gould through the village of how he only had a half-understanding of their current arrangements and that it was still not finalised. Now as this was still a rumour, it would be indecent of Dr. Grove to approach Gould but it overshadowed all previous thoughts of marriage. This rumour was also backed up with the fact that Gould’s letters had become more infrequent. Phyllis’ â€Å"heart sank within her† as she recognised the fact that her engagement had come to nothing. Despite of this father had noticed her attachment to Matthaus, he warned her not to go outside the boundary in her purpose of pursuing him, effectively making her a prisoner of her own home. However, she had no intention of leaving the garden however and the meetings continued as before. Then one evening an unforeseen accident destroyed her plans said to be decided by â€Å"fate†. She had been delayed by chance and Matthaus waited at the gate for her. The time he was due back in camp came and went but still he stayed. When she finally met him he was extremely late and on his return she heard that he had been stripped of his rank. The tragic consequence of this was that the chances of her father letting her marry him if Gould did not materialise had been slim but now they were practically nil. It was at this point that she makes one of the greatest decisions of her life. Matthaus had suggested that he was planning an escape from the army with several close companions and return to Germany and his mother. At first she seems amazed but then uncertainty steps in â€Å"I fear I am ruining you and your prospects†. However eventually she was persuaded but questions their route to freedom and how they propose to achieve it. Their scheme included stealing a boat and crossing across the channel to France. Here they would hike to Germany using their army wages to buy food and shelter. He asks to meet her just off the highway (symbolic of a turning point in her life) from where they should flee. He tells her that a friend of his, Christoph would also join them along with two others not named but who detested British authority. Coincidentally when she returned home, however, she found out that her father had spotted her with Matthaus. A confrontation occurred but her father had already decided she should go to her aunt’s to resist the temptation. He had still not given up faith on Gould, as he believed it was in best interest for her to marry him showing a paternal domination of his family. Her heart died within her as she heard this news and the house became like â€Å"a prison to Phyllis†, so she let her mind fly to the prospects of Matthaus’ scheme. Her confidence in Matthaus was fulfilled. On her return, she arranged to meet him at a junction off the main road the following week and when the time arose she waited just off the road hidden in a position where she could see any passers-by. The symbolic junction of the main road represents another turning point in Phyllis’ life where she has an option of which path to choose. She then hears a carriage come down the hill and stop nearby and as fate would have it Humphrey Gould, long awaited, stepped out. The carriage came down the hill as though Gould was lowering himself to Phyllis, in terms of class status. He talked to the driver about a present he had bought for Phyllis and he admits to treating her â€Å"rather badly†. In a rush of indecisiveness, Phyllis tries to make up her mind; should she be loyal to her father and Gould and return home or follow her instincts and leave to a new life. This again represents Phyllis’ lack of decisive action and passivity of women at that time and this concept is repeated several times throughout the story. At this point Matthaus climbs over the gate behind her and â€Å"presses her to his breast†. This is the first time that the metaphorical boundary of the wall has not divided them in their relationship. Phyllis left with them and after a long night of travelling to the coast they meet with the friend, Christoph, just before sunrise. At this point Phyllis makes her final decision and they separate for the last time on a hill overlooking the sea, dooming their relationship itself a metaphor as the sea represents freedom and this is simply describing how close she has come yet as it is dark she is still blind to it, her future an uncertainty. After she returns to her house, she finds Gould with an expensive gift – a looking glass which â€Å"won Phyllis’ admiration† and until that point she had regretted leaving Matthaus. However, things were to take a turn for the worse tragically after Matthaus had left. She finds out that whilst he had been away he had met a new lady, who would be a much better choice as she came from the same upper class background as Gould yet another example of class distinction which was obviously very powerful at that time. This shows how the value of money dictates Gould’s priorities. It is an irony that she finds this out on that day, as she would then not have hesitated to run away with Matthaus. Phyllis was shocked at this because she viewed Gould as a person who would confide every last detail of truth with her judging by the information in his letters. She retreated to the only place where she could be alone – the old wall-where she dreams about what her life could have been like had she taken the other route. One morning those dreams are brought to an abrupt halt. On a morning described as being â€Å"broke in fog and mist† behind which the faint outlines of tents and the camp were visible from the wall and this is against the permanence and regularity of the natural landscape. The mood is also set in an almost slow-time as Hardy describes in minute detail the landscape, such as â€Å"every blade of grass was weighted with little golden globes†, an image captivating the idealistic morning. As she watched in â€Å"melancholy regard† she sees a procession led by an English colonel, who represents the cultural background of Anglo – German hostilities. Two prisoners are led in front of a firing squad, clearly Matthaus and Christoph. After a prayer, they were executed in front of the entire regiment and their bodies ordered to be turned out of their coffins as an example to the men by the English Colonel, resented by the men. Tragically it turned out that they had stolen the boat as planned, and at first sight of land thought it was France and went ashore. It turned out it was Guernsey and the men were arrested and sent back to England so it was ironic that this mission that this mission seemed doomed to failure. It was simply undeserved misfortune they had arrived in the wrong place and a fault in navigation. On arrest, they had sacrificed themselves for the two other comrades by claiming to be ringleaders. Whilst the others had received a flogging, the punishment for desertion was death and so this order was carried out. As a consequence Phyllis symbolically died of a broken heart and was buried near where the two men lie. The idea of the love triangles that was stated at the start of this essay are the heart of the story. At the centre of both is Phyllis but on one is Gould and Dr. Grove her father. On the second is Matthaus and his mother, who Phyllis longs to be with. This story is an example of the number of external factors that can shape peoples destinies in life. It shows how chance events, such as Phyllis sitting on the wall at the time of Matthaus’ arrival along with tragic circumstances that arise, can affect the course of change. The idea is that we are powerless to control our destiny, and seeming coincidences may appear to be pre-ordained but fate is out of our control.

Certain individuals in our Korean society, at least those within my immediate community, have in one way or the other affected the way I think whether in reference to my studies or an aspect relevant to my social life. When Malcolm X’s discriminating eighth-grade instructor told him â€Å"no realistic goal for a nigger† exists at the time he was one of the best students who had foreseen career in law, the moment clearly marked a turning point in his educational decision. Mere words, thus, could ‘make or break’ a person and likewise, some of my perceptions during secondary years at school had been impacted by teachers and classmates in and out of academic discussions. Due to such an experience, I could say that formal scholastic training would be inadequate if a student neglects or fails to have access to other modes of learning. In my case, it was very esse ntial to get in touch with people in different ways. By the time I developed the habit of cramming prior to taking major exams back then, I was in constant need of companions who would either assist me in reviewing difficult subjects, especially the ones I got rid of the most, or simply accompany me for leisure or relaxing break after studying. I crammed so much that I ended up obtaining unpleasant grades that were quite bothersome not only to me but to my parents, concerned friends, and instructors at school who had seen and believed in my potentials. As it made me look into myself, I discovered that while I desired all along to keep up with my studies, I missed setting my priorities right. Friends who were fond of ‘happy-go-lucky’ times, I observed, bore a huge influence in the sense that I had spent an ample amount of time hanging out with them in parties, getaways, shopping, and even petty dates. Little did I realize that instead of having relief from stress of scho olwork, I earned distractions which reflected poor time management and lack of self-control on my part. I used to think that I could study well if I had moments to unwind first, so as to dissolve external pressures and worries which I thought might get in the way of focus but the more I seek to charge myself with wonderful mood as such, the more I became exhausted. The strength meant to have been reserved for making notes and working on assignments was all sapped, making me feel the need to have plenty of rest so that I crammed often. As a consequence, rather than getting properly organized with the lessons already taught, I unconsciously settled on losing my train of smooth thinking and whenever the trouble with discontinuity persisted, I would struggle with comprehension or with coping to recall subject matters dealt with. Though oppression was rare in the previous school I attended, students in general took part in throwing and receiving criticism. Somehow, this was embedded in o ur system of education and inevitably worked to test how strong a character could get, I suppose. Since I could not afford to let the situation with harshly criticizing individuals affect my personal growth in a negative way, I typically perceived comments as a sign of challenge capable of creating an opportunity for me to enhance my overall skills. Maybe it was because since childhood I have liked painting and construction and have yearned to create things on my own. I found these subjects very interesting.   After my graduation I worked as a planning engineer with the Ministry of Transport. The work experience I gained during that period helped to strength my specialization, improve my research skills, integrate my knowledge, and build my leadership skills. As part of my professional development I took additional training courses in various areas such as transportation planning, traffic engineering and scientific research.... The garden city concept combined the town and the country in order to provide the working class an alternative to working on farms or 'crowded, unhealthy cities'. Garden cities were intended to be planned, self-contained, communities surrounded by "greenbelts" (parks), containing proportionate areas of residences, industry, and agriculture (2). Letchworth was the first garden city, in the UK in 1903, followed by Welwyn in 1919. These were small in size, providing for a few thousand residents. In Australia, the suburb of Colonel Light Gardens in Adelaide, South Australia, was designed according to garden city principles. So too was the town of Sunshine, which is now a suburb of Melbourne in Victoria. New towns throughout the world were modeled after these garden cities. This theory was an attempt to improve the appearance of cities and streets by means of architectural and spatial effects. (3)   In 1920 the ideas of modernity began to appear by designer Le Corbusier brought more mod ern ideas and new methods of building and introduced the skyscraper. The main idea was to combine residential home designs with the feel of the city. This was also a way to use modern technologies to eliminate congestion and chaos that was experienced by small cities. He is simply telling us that doing nothing can be as good as doing something because it has psychological and physical benefits. First of all, idleness can be a form of relaxation to stop us from completely ruining our physical health. It is not uncommon nowadays to see middle-aged managers suffering from diabetes or heart conditions. More often than not, these busy lot of young leaders resort to unhealthy habits like smoking or over-eating as a coping mechanism to stress. They run like headless chickens when deadlines set in and fire orders like missiles to their subordinates. Later, they succumb to various health conditions because they simply failed to stop and smell the flowers. These people would extract productivity from most of their waking hours by doing work-related tasks even on moments where they could be just resting. In fact, even on a very busy workday, there is time to breath e and daydream. Hodgkinson advocates daydreaming or meditation when caught in circumstances that leaves us no choice but to wait like being stuck in a traffic jam (228). Apparently, traffic jams are blessings because these situations are beyond our control despite all the planning we can make. Normally, when a busy person gets caught in a traffic jam, he starts calling on other people to arrange matters due to delay. Busy people would never consider an idle time. On the other hand, the art of idleness teaches us to pray, meditate or daydream which can be more productive and healthy for our psychological well-being. Prayer and meditation calms the body and lowers blood pressure. A power nap is also good especially on long trips because we can recharge our brain. Daydreaming brings forth our creative thinking that can help us solve some conflicts that we are dealing with. Busy people often miss out the benefits that they can derive from such idle tasks that Hodgkinson suggests. Actual ly, the author is not telling people to be lazy and counter-productive. He is teaching us to rewire ourselves and explore the advantages of using idle time to make us more productive. Another issue that this book is trying to emphasize is the struggle between quantity and quality. The set-up of our lives depends on parameters that are quantitative in nature. For example, a person who goes to the gym boasts of the number of hours spent on doing exercises rather than the quality of the routine. Instead of feeling good about being able to exercise, fitness buffs would worry about the calories they eat or the hours they spent at the gym. Hodgkinson cited the nap that Winston Churchill took every afternoon which made him very productive later. Likewise, if we want our bodies to grow muscle or lose weight, we need to sleep well. The development of this concept began with Robert Hookes seventeenth-century observation that slices of cork were made up of small units he called cells. † Over the next 100 years, the cell theory emerged. It was formally (and independently) presented by Schleiden and Schwann in 1839, and clarified by Virchow a few years later. This theory has three principles: (1) All organisms are composed of one or more cells. (2) All life processes derive from the activities of cells. (3) All cells arise from preexisting cells. Living organisms are composed of one or many cells, and every activity that occurs in a living organism is ultimately related to metabolic processes in cells. Understanding the processes of life requires an understanding of the structure and function of the cell. Although cells vary in organization, size, and function, all share certain structural features. All are enclosed within a plasma membrane, defining the boundary of the living material. All contain a region of DNA (deoxyribonucleic acid), which forms the genetic code. Inside of the plasma membrane is watery cytoplasm, and the chemical processes inside the cell occur within this watery medium. Liberty of Thought and Discussion Essay John Stuart Mill: John Stuart Mill (1806-1873), British philosopher, economist, great liberal (or libertarian), moral and political theorist, and administrator, was the most influential English-speaking philosopher of the nineteenth century. His views are of continuing significance, and are generally recognized to be among the deepest and certainly the most effective defenses of empiricism and of a liberal political view of society and culture. The overall aim of his philosophy is to develop a positive view of the universe and the place of humans in it, one which contributes to the progress of human knowledge, individual freedom and human well-being. His views are not entirely original, having their roots in the British empiricism of John Locke, George Berkeley and David Hume, and in the utilitarianism of Jeremy Bentham. But he gave them a new depth, and his formulations were sufficiently articulate to gain for them a continuing influence among a broad public. Mills most famous work in social and political philosophy, and still one of the most influential works on human rights and freedom, is his book-length essay entitled On Liberty, which we will now summarize, using Mills own section headings. Introduction of the essay: The main point of this essay is to argue that the only justification for society limiting the liberty of an individual, whether by the government or the force of public opinion, is to prevent harm to others. If the purpose instead is his own good, or some other goal, then only persuasion and non-coercive means can be justified. Mill believed that an individual had two aspects to his life 1) The individual had two aspects which concerned him alone 2) The social because every individual was also an integral part of society. The actions of the individual may similarly be divided into two categories 1)self-regarding and2)other regarding with regard to actions in which he alone is concerned, his liberty of action is complete and should not be regulated by the state and society, his actions can justifiably be regulated by the state or society.. The essay also reflects Mills passionate belief that individuality is something that should be protected and nurtured. As such, the essay illustrates his disgust at how he believed society squelches nonconformity. On Liberty is just one example of the social and political writings of Mill other works of his include, Considerations on Representative Government Major Themes: The Struggle between Liberty and Authority Individuals have often felt as though their rights were being infringed upon by an overzealous government and have fought for the ability to have their government act they wish. Individual liberties have been trampled on by various governments and this fear of authority has resulted in democracies, where the majority of the people get to decide what actions are best for the state. Tyranny of the Majority With democracies, it is supposed that the will of the people is the impetus for the governments actions and that people are participating in a type of self-governing state. However, says Mill, this is not true, democracies enable a tyranny of the majority where public opinion stomps out the voices of the minority groups and pays their needs and opinions no mind. Mill thinks that this tyranny is the gravest sort, and seeks to find the maximum amount that society can impose itself on an individual while still maintaining personal liberty. Self-Regarding Actions and Autonomy A person whose actions only affect himself is not eligible to be coerced or punished for his deeds. According to Mill, it is not societys duty or even its right to protect a person from him or her. The only punishment that can result from a self-regarding action is the weight of individual public opinion and the consequence of the actual action itself. The Veracity of Public Opinion There is no guarantee, and even a strong possibility that what the majority deems to be best indeed is not. The majority’s opinion is tainted with motives and biases that shouldnt come into play when deciding what is best for society as a whole. An analysis of past events, wars, and discriminations can show us that sometimes the majoritys opinion is not rooted in good faith. Allowing the minoritys opinion to be involved in debates and decisions can only be a good thing, no matter what the opinion is. Religion and Liberty Supporters of religion tend to view those who are less religious as less credible in their ideas for society. Mill refutes this theory and says that religious affiliation should play no role in the ability of a person to make an informed opinion about what is best for all society the truth of matters. Mill points to nonreligious men with impeccable morals as proof that religious affiliation does not indicate trustworthiness. Coercion Mill is against societal or individual coercion in all cases, except when a persons actions are harming others. He thinks it a clear abuse of liberty when coercion is used to persuade a person to stop an action that only affects himself. When a person is injuring other members of society, however, Mill thinks it fine that he be coerced to stop his actions and punished in a court of law if applicable. Mill also believes that the public has the duty to warn each other about a dangerous person and coerce one another to stay avoid him/her. Societys Obligation Society has an obligation to throw its influence towards those who are unable to process information and exercise their own liberty in a rational way. Examples of these individuals are children and undeveloped minds. Society has an obligation to children to try their best to make them rational, reasonable adults who want to follow their passions and be dynamic personalities. Part of this obligation, one that is shared by parents, is providing a strong education Mill suggests that there be universal educational standards for all children so none fall behind. Danger in the Government: Mill is very fearful of the power of the government and all his theories are molded not to give the government any more power of persuasion or procedure. Mill thinks that governments should not be allowed to make the final decisions regarding its constituency, that rather local officials should be appointed and with the central government advice, but most importantly with the input of all citizens, make the decisions. The Liberty of Thought and Discussion: If people are oppressed for holding or expressing an unpopular opinion, there are three possibilities. In all three cases, the coercion is unjustified. One, the suppressed opinion might be true. Thats the most obvious case where suppressing it is unjustified. Two, the suppressed opinion might be false. Even here, though, there are advantages to letting it be aired as long and as fully as anyone wishes to air it. Even when the prevailing opinion it counters is true, it should never fear the challenge of a devils advocate. Such a challenge can only be healthy for it. Three, most likely of all, the suppressed opinion is neither wholly true nor wholly false. Only by airing all sidesboth the prevailing opinion and any views challenging it Of Individuality, As One of the Elements of Well-Being To hold an opinion never constitutes a harm to others, and so should never be suppressed. To express an opinion almost never constitutes a harm to others, and so should only be suppressed in rare, extreme circumstances. Behavior is clearly different and can often constitute harm to others, thus it is not entitled to the same near-absolute liberty. However, even with behavior there should be a strong presumption in favor of liberty. Any alleged harm to others has to be clear and provable. When theres doubt, the behavior should not be suppressed. Many of the reasons for this parallel the reasons for freedom of expression. Just as expression might be true, false, or partly true and partly false, so might ones actions be right, wrong, or partly right and partly wrong. When theyre right they should be allowed, and when theyre wrong or partly right and partly wrong, its often best to allow them to stand as a challenge to the prevailing approved behavior, so people can best judge all the possible behaviors. There will be no positive change for society as a whole if people are not allowed to experiment with behavior that is contrary to custom and the opinion of the majority. Every progressive, positive change in history that has added to human happiness was at one time contrary to custom. To develop ones individuality, ones capacity for autonomously choosing ones own path in life, fosters happiness in and of itself, aside from the consequences of the specific behavior chosen thereby. Even if superficially it is the case that other choices coercively imposed would have been better, this benefit of being an autonomous person is lost. Unfortunately, in the modern era people seem all too blind to the value of liberty and individuality. Little is shunned or looked down upon more than eccentricity or acting contrary to custom. Of the Limits to the Authority of Society Over the Individual Every member of a society is obligated to refrain from harming others, and to provide his share of the labor and sacrifices necessary to safeguard and maintain that society. Society has the right to compel people to fulfill such obligations. If the harm rises to the level of violating the rights of others, then the law may be used against such harmful behavior. If the harm is of a lower level, then only the force of public opinion may be used against such harmful behavior. If the behavior is not harmful to others, then no coerciongovernmental or otherwisemay be used against it, and people may only seek to influence it by persuasion. It can be argued that harm to self can then harm others and so should be included in what can be suppressed, but this harm to others is too indirect and speculative. Plus, the individual is generally in the best position to know what constitutes harm to self, and so is the one who should make the decisions. Applications Not even all instances where behavior in some sense harms others should be suppressed. Sometimes people will be disadvantaged or have their liberty limited by the way other people exercise their liberty (e. g. , one person is prevented from getting a certain job because the employer hired someone else), but this is unavoidable and is normally not proper to categorize as a coercive infringement on liberty. Should people be free to obtain and possess weapons and such that are used to harm others? Mostly yes, because the potential to harm is not to be treated as the equivalent of harm. In some cases, an acceptable middle ground should be sought, for instance allowing people to own such things, but keeping strict records of their name and address, what they purchased, their stated reason for purchasing it, etc. There can be rare cases of justified paternalism where a person is coerced to prevent harm to self. An example would be physically blocking a person from crossing a bridge until it can be explained to him that it is unsafe. Because here youre not really thwarting the persons will, which is to get to the other side of the bridge, not to plunge to his death trying to cross it. There can be rare cases where a persons track record justifies intervention before the actual harm to others. If a person has an established history of violence when drunk, it may be justified to forcibly prevent him from getting drunk. There can be instances of offense that are so severe as to rise to the level of harm, and thus justify disallowing certain behaviors in public, where it would not be justified to prohibit those behaviors behind closed doors. Generally if it is wrong to use full coercion against a behavior, then it would be wrong to use partial coercion. For instance, if it would be wrong to make a certain thing illegal because its not directly harming others, it would also be wrong to tax it so heavily as to discourage it without banning it outright. Should a person be free to limit his own future self by entering into binding contracts? This will depend on the specifics. To not allow and enforce contracts would itself be a limitation on liberty, as would enforcing all contracts (e. . , slavery contracts). The law should seek a middle ground that maximizes freedom by enforcing contracts, but only with numerous safeguards, limitations, and exclusions. One area where some people are allowed far too much freedom in ways that harm others is in the family. Men are wrongly regarded as having sole authority in their home to deal with their wives and children as they see fit. The law should step in, even coercively where necessary, to ensure that women have the same rights, the same liberties as men. A question that is only indirectly related to the primary concerns of this essay is the proper size and role of government, beyond the matter of its placing direct limitations on the liberty of the individual. As a rule of thumb, smaller government is better, because individuals are in a better position to make decisions about their own lives and resources than is local government, and local government is in a better position than the national government.
